Scope: cookies and equivalent storage

A cookie is a small file that a site asks the browser to retain and return with each subsequent request. Local storage is treated in the same way, serving the same function: both constitute the storing of information in the terminal equipment of a user under article 5(3) of the ePrivacy Directive and, in Italy, under the guidelines of the Garante of 10 June 2021.

The distinction matters here only because this site sets no cookies at all. What it holds is a single entry in local storage, which is never transmitted to a server.

The one entry stored, and why it needs no consent

Article 5(3) of the ePrivacy Directive exempts storage that is strictly necessary to provide a service explicitly requested by the user. Choosing a theme is such a request, and the entry exists only to honour it.

• toooly.theme light or dark, written only where the switch has been operated. Local storage, retained until browsing data is cleared. Never transmitted, and not readable by the operator of the site.
• Nothing else no identifier, no session, no record of which tools were used and no consent record, there being no consent to record.

Why there is no cookie banner

A consent banner exists to obtain consent. This site carries nothing that requires it: no analytics tag, no advertising, no third-party script of any kind, and one exempt entry in local storage. A banner here would be asking permission for something that does not happen.

This is verifiable rather than asserted. In the network tab of the browser developer tools the only requests are for the page and its own assets, served from this domain. Fonts are compiled into the site at build time instead of being fetched from a font service, which is the request most sites make without noticing.

Deleting what is stored

Every browser can delete site data for an individual site, which removes the theme entry. The site then opens in the system default theme and operates identically in every other respect.

A browser configured to refuse third-party cookies entirely, or to block storage altogether, changes nothing here: no tool ceases to function, and the only consequence is that the theme is not remembered between visits.

Processing not carried out

For completeness, the following are not present on this site.

• Analytics no Google Analytics, no alternative analytics tag, and no server-side measurement of visits.
• Advertising no advertising network, no advertising cookie and no advertising slot.
• Tracking pixels no Meta pixel, no TikTok pixel, no LinkedIn insight tag and no third-party beacon of any kind.
• Fingerprinting no reading of canvas, fonts, audio stack or device list in order to construct an identifier that survives the deletion of site data.
• Cross-site disclosure no activity on this site is reported to another site, and no audience list is constructed or exported.
• Storage for search reporting Google Search Console, which reports how this site appears in Google results, is verified by a google-site-verification meta tag or a DNS record. Neither loads a script nor stores data on the user device.
